General Terms and Conditions - T&Cs

1. Scope of Application

The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity (§ 13 BGB).

3. Conclusion of the Contract

  • The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

  • By clicking the button [Buy/order with obligation to pay], you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by email after receiving your order. The order confirmation automatically sent by the system after the order is not valid.

  • Storage of the contract text for orders placed through our online shop: We store the contract text and send you the order details and our T&Cs by email. You can also view the T&Cs at any time at https://www.hangaia.de/agb. You can view your past orders in our customer area under My Account --> My Orders.

4. Right of Withdrawal

  • If you are a consumer (that is, a natural person placing the order for a purpose that cannot be attributed to your commercial or self-employed professional activity), you have a right of withdrawal in accordance with the statutory provisions.

  • If, as a consumer, you exercise your right of withdrawal pursuant to section 4.1, you shall bear the regular costs of return shipping.

  • In all other respects, the provisions set out in detail in the following withdrawal instructions apply to the right of withdrawal.

 

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, have or has taken possession of the goods. In the case of a partial delivery, the period begins on the day the last delivery is received.

To exercise your right of withdrawal, you must inform me, Jeremy Gotzler, c/o IP-Management #9545, Ludwig-Erhard-Str. 18, 20459 Hamburg, +49 (0) 151 / 4127 5862 and info@hangaia.de of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, although it is not mandatory. You may also complete and submit the model withdrawal form or another clear statement electronically on our website (insert internet address). If you make use of this option, we will immediately send you confirmation of receipt of such withdrawal, e.g. by email.

To meet the withdrawal deadline, it is sufficient for you to send the notification that you are exercising your right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their condition, properties and functionality.

  • Prices and Shipping Costs

    • The prices stated on the product pages include statutory VAT and other price components.

    • In addition to the stated prices, we charge shipping costs for delivery. The shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system and on the order page.

    • If the goods are shipped to countries outside the European Union (EU), different additional costs may arise depending on the delivery country, such as taxes and/or customs duties, which must be borne by you.

  • Delivery

    • Delivery is made to Germany, Austria and the Netherlands with DHL.

    • The delivery time is up to 5 days. We will indicate any differing delivery times on the respective product page.

    • The processing time depends on the items ordered and is up to 3 days. Information on differing processing times can be found on the respective product page.

  • Payment

    • Payment can be made by advance payment, Klarna or PayPal.

    • If you choose advance payment as the payment method, we will provide you with our bank details in the order confirmation and deliver the goods after payment has been received.

    • If you choose Klarna or PayPal as the payment method, the goods will be shipped as soon as we have received confirmation from the payment service provider.

  • Retention of Title

    • The goods remain our property until full payment has been made.

  • Dispute Resolution

    • The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court resolution of disputes concerning contractual obligations arising from online purchase contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.

5. Member Account

  • In order to access and use certain areas and functions of our site, you must first register and create an account (“member account”). You must provide accurate and complete information when registering your member account.

  • If a person other than yourself accesses your member account and/or your settings, they may carry out all actions available to you and, for example, make changes to your member account. We therefore strongly advise you to keep the login details for your member account secure. Such activities may be assumed to have been carried out for you and on your behalf, and you alone may be responsible for those activities carried out through your member account - regardless of whether they were expressly authorised by you or not - as well as for any damages, expenses and losses arising from them. You are liable for activities in connection with your member account in the manner described if you have negligently enabled the use of your member account by failing to exercise appropriate care in protecting your login details.

  • We may permanently or temporarily block or suspend your access to the member account, without any liability claims on your part, in order to protect ourselves, our site and our services or other users if, for example, you violate provisions of these terms or applicable law or regulations in connection with your use of the site or your member account. This may take place without prior notice if the circumstances require immediate action; in this case, we will inform you as soon as possible. In addition, we reserve the right to terminate your member account by email with two months’ notice if, for example, we discontinue our member account programme. You may stop using the account at any time and request the deletion of your member account by contacting us.

6. Prices / Shipping Costs / Payment

  • All prices are total prices and therefore include all statutory price components. No VAT shown due to the application of the small business regulation pursuant to Section 19 UStG.

  • In addition to the stated prices, we charge the shipping costs specified in the respective item offer per order.

  • The consumer has the option of paying by direct debit, PayPal or credit card (Visa, Mastercard).

7. Delivery

Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery is made within 4 working days at the latest. In the case of advance payment, the delivery period begins on the day after the payment order is issued to the bank commissioned with the transfer, and for all other payment methods on the day after conclusion of the contract. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.

8. Retention of Title

  • We retain ownership of the delivered goods vis-à-vis consumers until the purchase price has been paid in full.

The statutory warranty provisions apply.

The contract language available is German only.
